Arizona Group Homes
Much of the law in Arizona relating to the rights of the developmentally disabled residing in a group home are set forth in the Arizona Administration Code R6-6-801 through R6-6-901; Arizona Revised Statutes 36-551 through 36-596; and 46-451 through 46-455.
It took a long time for our society to recognize that people with developmental disabilities in this state are guaranteed all the rights, benefits, and privileges in the constitution and laws of the United States and the State of Arizona. This includes the right to protection from physical, verbal, sexual, or psychological abuse or punishment. For years Knapp & Roberts has been fighting to protect the rights of individuals with special needs by taking legal action to hold those responsible for the neglect and abuse of this vulnerable population. Unfortunately, many cases result in a death or serious injury that was clearly preventable.
Group home placement in Arizona may be made by Arizona's Division of Developmental Disabilities ("DDD"), by private placement, or upon recommendation by a medical provider or case manager. Whichever group home is chosen for your loved one, it is important to understand that the group home and the State of Arizona both have a legal responsibility for his or her safety and well being.
If you believe you or a loved one has been injured or suffered a wrongful death as a result of group home neglect or abuse, call Knapp & Roberts today for a free consultation.
